Pulse of Europe Canarias supports the rule of law procedure initiated by the European Commission against Poland
Europe must defend its legally binding values. The abolition of the rule of law in one Union member state affects automatically also the citizens in other countries.
Pulse of Europe - Canarias supports the European Union which is taking action and activated the Article 7 TEU and infringement procedures to protect the rule of law in Europe.
Judicial reforms in Poland mean that the country's judiciary is now under the political control of the ruling majority. In the absence of judicial independence, serious questions are raised about the effective application of EU law, from the protection of investments to the mutual recognition of judicial decisions in areas as diverse as child custody disputes or the execution of European Arrest Warrants.
Over a period of two years, the Polish authorities have adopted more than 13 laws affecting the entire structure of the justice system in Poland, impacting the Constitutional Tribunal, Supreme Court, ordinary courts, National Council for the Judiciary, prosecution service and National School of Judiciary. The common pattern is that the executive and legislative branches have been systematically enabled to politically interfere in the composition, powers, administration and functioning of the judicial branch.
The EU urgently needs to demonstrate to its citizens that it has the wherewithal to stand up for pluralism and the rule of law within its own family. A failure to do so will only undermine the Union’s effort to demonstrate that it is a civic community held together by democratic values, not just a distant, unaccountable bureaucracy — exactly what the populists falsely claim.
